PRESIDENT OBAMA’S HEALTH CARE SPEECH

            Last night President Obama made what was touted by much of the media as a major address to Congress and the American people on healthcare. I’m not going to write a lengthy response to the speech because first, there was really nothing new in it, and secondly, he did not address the Constitutional issues. In fact, most of the health care bill supporters are running like mad from having to respond to questions from Americans on those issues.

            Instead, they take the arrogant and elitist approach that the President took last night; accusing all who oppose the enlightened paternalism of the left of either being evil or just too dumb to know that we have to be taken care of by “Big Brother”. In other words, there was little in the speech that I have not already addressed in my previous articles posted here.

            There is one issue that I need to address however, since not only have the President and members of Congress been making a point of it, but I have received several e-mails asking me about it. That is the question of whether illegal immigrants will get medical care under the provisions of HR 3200. My answer is clearly yes. This is disputed by those who point to Section 246 of the bill that is titled: “No Federal Payment for Undocumented Aliens”.

            That seems clear enough, but what does it really say in the section. There is only one sentence in the section and it states:

“Nothing in this subtitle shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States.”

All that says is that affordability credits to help them get insurance are not available to illegals. It does not say that they can’t participate in the overall program and get reduced cost insurance under the so-called “public option”.  Nor is there anything in the bill that requires someone to verify their citizenship to get benefits from the Insurance Exchange in the program. Any enforcement provisions were specifically excluded in the House Committee. The bill also doesn’t limit the care currently being provided for free at emergency rooms and government clinics. The access of illegal aliens to the system has been verified by a recent report released by the nonpartisan Congressional Research Service. This service works for Congress and the report was released days before President Obama made his speech, yet he continued to deny that illegals will get coverage. There is also a movement among some members of Congress to grant illegal immigrants full rights to participate in all government programs including Social Security, even if they have never paid a penny into the system.

            Is it Constitutional to require American taxpayers to pay for medical coverage of those who have broken our country’s laws by sneaking across our borders? Nobody in the Obama Administration seems to care.

Your comments are interesting and I applaud your attempt to inform. However, you don't cite any of your sources. For instance, which of the 5 bills before Congress on healthcare are you referring to? All or one or several? And be specific about what part of our constitution you believe the healthcare bills violate. One of the major reasons conservatives have made less headway against these bills is that people are uneducated about our legislative and legal system. And then they only get information from people like Rush Limbaugh and Sarah Palin who "rant." We don't need hysterics, we need excellent verifiable information. With that information, people will be armed with the TRUTH and be able to sucessfully deal with the liberals' falsehoods about what the bill(s) will do, who will be covered and how much it will cost. It is the longest and most involved one. In the comments under that post I responded to requests to cite specific sections of the bill by doing just that.

Thank you for taking the time to read this bill and breaking it down into what is real and what isn't. What do we have to do to protect ourselves from this tyranical bunch in DC? Please keep us informed on what is the real truth (not the truth [lies]) those in congress are passing around. Obama is not what many seem to think he is and it is strange to me that they can't see him for what he really is. Just another illegal alien who wants a handout.

I have tried to read the Helath Care Bill and as a lay person was quite confused. Thank you for explaining in terms i can understand. I did not believe Obama in his speech the other night and you have confirmed that he was, in fact, not being honest. If in fact he wants what he has said to be in the bill then they will have to rewite it as they need to do on a bipartisan level. I have sent your e-mail to all my friends. Some of whom are quite liberal. I am anxious to hear back from them to see what their take is. The fact is this should not be a Republican or Democrat, Conservative or Liberal Issue. It should be an AMERICAN PEOPLE. ISSUE.

So what are we, as friends of the Constitution, going to do? I've been hearing for months of all the attacks on our sacred document, and other than Tea Parties and calls to reps, I feel our hands are tied. There is no doubt I feel our
Constitution has been violated by elected officials. 'Worse, I sense a leftist wave of pushing even further from our founding fathers insights. It scares me. It saddens me. I don't want my kids not having the America we grew up with; not living in the most powerful, gracious and generous nation on Earth.

I really appreciate you taking the time to break this down for us. Last week I really started doing some digging on Obama's czars. What I found was frightening. Cass Sunstein and Richard Thaler are an extreme threat to our Constitution. I haven't had a chance to read Sunstein's books yet, hopefully I can find a few before they start to disappear off the book shelves. Such as Holdron's, the science czar, book titled Ecoscience seems to be difficult to find. As I am sure you are aware, Cass also teaches Constitutional Law. His books titled, "Democracy and the Problem of Free Speech", "The Second Bill of Rights" and the book, "Nudge" co-authored with Richard Thaler really caught my eye. I have a feeling his idea of how to teach Constituional Law vary from what your beliefs are and mine. Something else that caught my eye was the Volokh Conspiracy that Sunstein supports. When I researched this Volokh Conspiracy the only hit I got throught the web was Eugene Volokh, a law professor at UCLA developed this conspiracy which focuses on and supports soft paternalism. Soft paternilism-the state can help you make choices you would normally make for yourself. These are just some of the people our President is surrounding himself with.
My question for you is; the information I gathered above is it accurate according to what you have? What can I do about stopping this wheel in motion. Contacting our Senators and Congressmen? Most don't seem to see what the rest of us are seeing. How do we stop this before it is to late and the Constitutional changes have already been made?
I would also like to add that my family has lived overseas for 11 years and we have used the government run healthcare systems throughout the world, England, Germany and Japan. We have private insurance so we got the best of the worst. I wish I could share with everyone the stories I have and they are truly scary.

You have done a great service by dissecting HR3200. However, your blog doesnt have the reach to make a difference. I suggest every reader copy the piece revealing the specific Constitutional violations of HR3200 and send them to every newspaper in your area. Include a request for every reader to call their representatives AND Senators ak ask them not to participate in this atrocity. Let's see if we can spread the word before it is too late.

Though it seems to be a fools errand, we need to keep the pressure on the dolts who support H.R. 3200 as well as the other progressive bills. The press won't report our opposition, and the administration ignores any and all dissent. Pester your elected representatives, stay off the radical internet blogs, listen to talk radio and watch FNC. Eventually, we will have the opportunity to vote the progressives out of office, so it is important to remember what has taken place since 2006 and mete out the punishment in 2010 -- and just as importantly in 2012.

This is wildly biased and erroneous. First, Michael Connolly is not a constitutional lawyer. His credentials are that he is a retired "instructor" meaning he has few academic credentials and he is retired. Obama is a constitutional lawyer with much more impressive credentials than Connolly and I'm sure they do not agree.

As for a leftist wave, I sense a radicalization of the right wing. Rush Limbaugh is who everyone looks to to decide what they should think and say. That includes Sean Hannity and Michael Savage and Ann Coulter. The old saying still goes, "America...love it or leave it". If you all are so dissatisfied with America why don't you go to another country to whine or try to be constuctive.

The writer of this crap is transparent. He hates that Obama was elected, he hates all democrats, he hates... The goal is to stir to anger. His points are weak at too many locations to mention. If we are honest about libertarian ideals, then all you people on Social Security and Medicare should give it up. You paid in to it for the years you were working but it was given to the people using it at that time. You that now receive these supplements (entitlements) are getting them at the expense of working taxpayers today. There was never any fund out from which you could draw your current payments. Don't like the the "government" set it up that way? There was no choice, the old people in 1964 didn't have any income to live on and had never paid in to it so it started paying to those that had never paid. You can blame them but the fact is the majority rules and that's what became law. If you want to look at entitlements, old people take too much. This post is biased and takes Obama's comment out of context: you focus only on HR3200 when it has been dead in debates for quite a while now. That, and Obama has nothing to do with HR3200, and is on video from March through July saying he will not get involved and let congress work it out.

To Terry......I am one of those seniors who "don't deserve to collect my Social Security". I worked 47 years in the SS System and paid into it even when I was self employed and a business owner. I earned every cent of the less than a $1000 a month I get and for you to tell me I don't deserve it but an "criminal" Alien who breaks our laws and uses our resources should be allowed access to our health care and other programs tells me you are as insane as a person can be. Go hide somewhere because as far as I'm concerned you should be prosecuted as a traitor to this country that I love.

Also in 1964 many states had "Old People's Pension" which provided some income and people who loved their elders took care of them; unlike today when so many are stuck in Old Folks Homes and forgotten.

Terry pretty much nailed it. This guy really only speaks to the 'NO!' crowd: those people who are against everything no matter what and don't bother to think for themselves. He and his crowd have no redeeming social or political value and are just pawns of the big insurance companies who stand to gain billions of dollars with the failure of national health care. They are stingy, greedy and hard hearted.

It's the job of congress to write laws and the president's job to administer laws. Obama cannot write any laws regardless of what he promised. He uses fear and misleading statements to scare people into supporting him just like his opposition does to object to policies they don't agree with. Based on his policies, his knowledge of the constitution is questionable. But we all must stop attacking the man and just attack the policies that we don't agree with. If it's illegal to use the funds to cover all of someone's insurance, it's also illegal to use the funds to cover part of someone's insurance. The ban on funding illegals is clear and simple. Perhaps that confuses some, but it shouldn't.

You should also acknowledge that granting illegals access to insurance probably would be a huge cost savings to the nation. Since illegals provide net gains to our economy, keeping them healthy provides two benefits -- it helps stop the spread of disease and it keeps those benefits rolling to those of us who are legal.

Someone sent me a letter attributed to you which alleges that H.R. 3200 grants access to private health data to "Obama appointees." That's not in the bill -- perhaps you could point us to a section that you think says otherwise -- and it's patently illegal under the Health Information Portability and Accountability Act.

Health care costs are breaking our nation's back. All I see here is carping about Obama's trying to fix it. If you don't have anything positive to add to the discussion, can you at least be more polite by being more accurate?

Please people, stop giving the government evidence that you are too stupid to make decisions for yourself. The references to the bill are on the site, you have to look. I have also read the bill-and as a layperson cannot decipher much of it. So much for transparency. Thanks for translating the verbiage for us.

A question: I understand that this is a bill that must go before House/Senate that is passed or not. Jesse; The bill HR3200 calls for 52 agencies to be set up to run this fiasco. I think that will drive up the overhad just a bit. I don't understan how spending a trillion dollars will reduce the cost of health care. Also, of those 47 million people you refer to, 10 to 12 million are illegal imigrants, 10 t015 million are young people who want to spen their money their own way, another several million qualify for medicaid but do not apply. Oh. I forgot the several million who make over 75 thousand per year but refuse to buy insurance. And, finally, it is impolite to use all caps. It is considered a form of shouting

I have worked in hospitals since 1989 and I can tell you hospitals will go broke providing "free" healthcare for anyone. Nevermind they are illegal, legal, lazy, broke, black, white, or whatever. The Bible says if you don't work, you shouldn't eat either.

Too bad issues like this, discussed by strangers on the internet, end up as just so many personal insults. I am a conservative who is always perplexed at accusations (like from various readers above) that we all get our daily marching orders from Rush & Sarah. I don't listen to Rush, as he is just an entertainer, and I am embarrassed by Palin.

I'm a serious conservative willing to listen to all sides and find the common ground. I find Mr. Connelly's points to be much more informative and objective than what I hear & see in the normal news outlets. I also look for equally serious and civil opposing views, but those are unfortunately are somewhat lacking in some of the respondents here.

Being conservative does not mean being reactionary. Among other things, and in context of the health care debate, it just means believing more in the power and the role of individuals, vs the collective, in solving individuals' problems.

As someone who works on the hill I never heard about this "movement" which implies something different than what Mr. C. argues to begin with. Just which Amendment would that be, I'de like to know.

Nevertheless, the whole illegal issue is a Red Hearing anyway because there is NO CURRENT LAW that prevents the charges and the whole twisting is to make it look like a new proactive move. Additionally, the arguement made about the 10th Amendment is silly because the Federal Gov't makes laws all the time that govern what States do and much of it has been infastructure like when Eisenhower built roads.

Someone should reallly do more homework about who and when Heathcare legistlation was originally written and discover who it currently favors and why.

It's laughable but sad how so many Sr.'s complain about gov't healthcare all the while a recipient of Medicare - GOV'T RUN HEALTHCARE. BTW, Insurance Co already ration care, ever been denied coverage for something you felt should have been? Happens all the time to common folk, Democrats and Republicans alike.

No. When we read God's word it is important to be observant of the total content and context. What you speak of... "The Bible says if you don't work, you shouldn't eat either." is in fact the Apostle Paul speaking in
2 Thessalonians 3: 8-13 in reference to something he heard about some "which walk among you" being disorderly and not working at all. He was speaking to the church about church people... not to or about the populace at large. So to use this scripture in the manner you did, qhaddie321 is in fact to "twist" God's word. If we are going to use God's word to determine the result of this health care reform, then we must indeed do what Jesus did. When it came to the multitudes, He healed them without charge or proof of their deserving it ... He just did it. Even our very salvation is/was undeserving, but He did it. He layed down all that He was and all that He had that you and I might find eternal life. So here we are, a "Christian Nation" worried about how it might inconvenience us if we extend health care to those who can't afford it or don't "deserve" it and there in lies my struggle because in the end, nothing I have is mine... He is the giver and taker of all things right down to my ability to produce a good living for my family and afford private insurance. Perhaps it would do our "Christian Nation" good to fall to our knees and pray for God to humble us and then we should do as we are instructed in Romans 13 and pray for our government. And if this health care reform does indeed violate the constitution, (which I am still not convinced that it does), perhaps we should then ask God which is more important, our constitution, or His word.

I find it odd that so many people (like Jesse) think that the Big Bad Insurance companies are what drives price of healthcare up so high. Insurance premiums increase every year because the cost of healthcare increases every year. Healthcare costs drive premiums, not the reverse.

But it's easy to demonize Big Insurance. Besides, all the lawyers in DC would never countenance tort reform as a natural starting point.

And, Jesse, if you think Medicare is well-run and efficient I don't know what to tell you. Did you know it's bankrupt? Did you know that it drastically underpays medical providers - a key reason the rest of us pay so much is to make up for the difference in what Medicare and Medicaid pay (and what is given free to illegals and delinquents who don't pay). But hey, the lack of personal responsibility is a big part of the puzzle isn't it? Big Brother should take care of me - it's my right!

If you all want to see the example of government run health care that has already been around for a long time, take a VERY close look at the VA system in this country. For those ignorant people out there it is the government run health care system for the veterans of this country. Ask the vets how they like the VA system. One thing that has not been mentioned here, of all the talk about this Obama health care change, no one has talked about asking your local representatives if they will be on the plan? They will say no, but the rest of us have to accept it? It should not matter if you are left or right with your politics. You should not accept a program that the politicians are voting on that puts YOU on a government run health care system that they refuse to be on. That is just plain unacceptable! That is what the debates should be about. If its not good enough for the politicians, why should we accept it?

Ace, I find it interesting you are defending the insurance companies. They are not in business to pay for our health care, they are there to make money. What do you think drives up health care costs? The biggest..malpractice insurance for the providers, yes, an insurance company. that along with a majority of patients on medicare which sets payment limits for docs force docs to raise costs. Then throw in the free care that hospitals are forced to give to illegals and uninsured (objectively speaking) and one can see the massive increases we see in costs. Hospitals have to make money to stay in business, so do the docs, and yes so do the insurance companies. All need to keep the profit margin. So, with that being said, we can eliminate insurance companies with health care co-ops. co-ops are very successful in the mid-west and that can eliminate the money hungry insurance companies.

You take the provisions of HR3200 out of the statutory context in which they would be implemented. Namely, you disregard the current law at 8 USC 14 ("RESTRICTING WELFARE AND PUBLIC BENEFITS FOR ALIENS"), and specifically subsechapter I, which spells out eligibility.

Current medical assistance programs (aside from emergency care) already exclude the undocumented, what this bill does is rewrite the structure of how those existing programs are carried out. The reason Section 246 explicitly excludes them is that the affordability credits are a new addition to the existing programs providing payments to the private sector, so the pre-existing exclusions wouldn't necessarily apply.

In other words, what the bill proposes is to keep the current system (including restrictions in other laws that the author either ignores or doesn't know about) but modify the way it pays and what it pays for, not who it pays on behalf of. As such, the existing exclusion of the undocumented remains in place. Section 246 adds a new benefit involving the private sector, and so it specifically spells out that those same exclusions will apply to the new benefit.

As for that stuff about a growing movement to provide aid, I only have two things to say: first, either cite something to back this up or acknowledge that it's simply another scare tactic; second, are you arguing that unless the President addresses any future intention of any unknown person or persons with regard to changing his proposal... that he's lying? That's the same as me saying "further, your post is a lie, because I heard other people are thinking about writing another post in the future that says something different." Absurd.

It is sad that so many people will believe the stuff you write. How much did you get paid to write these untruths, and who did you receive payment from?

Why are you attempting to devide this country? What happened to land of the free, and home of the brave? Americans are afraid, and fear mongers like you are taking advantage of the fearful Americans?

It is also sad that so many people will not consider, let alone believe, the stuff written.

It is even sadder that so many people are have no idea of the value of their rights under the Constitution and are so willing to become or remain sheople, lead by incompetent flock masters from one baron gazing field to another.

Believe me, that if there was a way to protect MY rights and our country while leaving you to rejoice in a different realty, it would be a no brainer.

I truly don't understand much of these bill(s), however I feel enlightened, but.....I must say, I am paying approx. $1000 per month for my healthcare insurance and need a break! Private insurance companies have medical professionals working for them in a sense with telling a doctor how much they will pay, so they have to see twice as many patients, maybe even more to make any money at their profession, given what the investment is to obtain their degree. In other words, we still need to fix what's wrong, the fact that I need a part time job to pay for my health insurance and it doesn't matter to me if you are far right or far left, this just has to be fixed!
